This document is an official offer by Mytrade.kz LLP (hereinafter referred to as the “Company”) to enter into an agreement on the terms set out below with any individual or legal entity (hereinafter referred to as the “User”) who accepts this offer (hereinafter referred to as the “Offer” ). The offer is public and unconditional.

1. General provisions

1.1. This Offer governs the terms of use of the Mytrade.kz marketplace (hereinafter referred to as the “Platform”) and is a public offer in accordance with Article 395 of the Civil Code of the Republic of Kazakhstan.

1.2. Acceptance (acceptance) of the Offer by the User means full and unconditional agreement with the conditions set forth in this Offer and the Rules for using the Mytrade.kz marketplace (hereinafter referred to as the “Rules”). The Rules are located at: https://mytrade.mydev.kz/en/rules.

2. Subject of the Offer

2.1. The Company provides the User with access to the Platform for posting advertisements, buying and selling goods and services, renting, exchanging and other activities provided for by the functionality of the Platform.

2.2. The User undertakes to comply with the terms of use of the Platform set out in this Offer and the Rules.

3. Rights and obligations of the parties

3.1. Rights and obligations of the Company

3.1.1. The Company undertakes to provide the User with access to the Platform in accordance with the terms of this Offer and the Rules.

3.1.2. The Company has the right to change the terms of this Offer and the Rules, notifying Users of this by publishing changes on the Platform.

3.1.3. The Company has the right to block or delete User accounts if they violate the terms of this Offer and the Rules.

3.2. Rights and obligations of the User

3.2.1. The User undertakes to provide accurate information when registering and using the Platform.

3.2.2. The User undertakes to comply with the terms of this Offer and the Rules, as well as the current legislation of the Republic of Kazakhstan.

3.2.3. The User has the right to use the Platform in accordance with its functionality and the terms of this Offer.

4. Responsibility of the parties

4.1. The Company is not responsible for the content of advertisements posted by Users, as well as for the actions or inactions of Users when using the Platform.

4.2. The User is responsible for all actions performed under his account, including the accuracy of the information posted on the Platform.

4.3. In case of violation of the terms of this Offer and the Rules, the parties are liable in accordance with the legislation of the Republic of Kazakhstan.

5. Validity and termination of the Offer

5.1. This Offer comes into force from the moment of its acceptance by the User and is valid until its termination.

5.2. The User has the right to terminate this agreement at any time by ceasing to use the Platform and notifying the Company.

5.3. The Company has the right to terminate this agreement if the User violates the terms of this Offer and the Rules by notifying the User.

6. Other conditions

6.1. All disputes arising in connection with the use of the Platform must be resolved in accordance with the legislation of the Republic of Kazakhstan.

This Offer is a public contract and is binding on all Users of the Platform.
